Recent Federal Court Decision

Ok, if you are part of the group I don't have to tell you that a federal court judge just ruled that some of the wire tapping was unconstitutional...

Of course the fight won't be over until the Supreme Court rules on it and it has to work it's way up the courts first...

But that doesn't have to keep us from a friendly debate on whether we think it was the right ruling - AND WHY WE THINK THAT...

Whatcha think? Anyone game?

Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

By definition, warrantless searches are, well, unwarranted. There's already the Foreign Intelligence Surveillance Act to cover exceptions namely in its Title III. Additionally, the mass warrantless wiretapping violates the separation of powers doctrine, the Administrative Procedures Act, the right to free speech, and is what momma always said only them commies would do to their citizens.
